Excise Duty Concession for Persons with disabilities

National Overseas Sch olarship for Students with DisabilitiesThe guidelines for issue of an excise duty concession certificate on purchase of cars by the persons with disabilities was first brought to the notice of the Public at large by this Department’s letter no. 12(18)/98-AEI dated 19th June 1998 which is placed at Annexure-I (download pdf). The guidelines is summarized as under:

  1. The Ministry of Finance, Government of India, has allowed a concessional rate of excise duty of 8% as against the applicable rate of 16% and 24%
    • on cars being able to be driven by the physically handicapped; or
    • on cars which has been suitably designed to be able to be driven by physically handicapped; or
    • on cars meant for physically handicapped.
  2.  The Notification issued by Ministry of Finance, inter alia stipulates that this concession can be claimed on if a Deputy Secretary/Director in the Ministry of Industry certifies that the vehicles is fit for use by the handicapped persons .
  3. The Department of Heavy Industry has framed guidelines for issue of such certificates to the handicapped persons. As per the guidelines, the applicants are required to submit the following three documents, in original in the prescribed format.
    • A medical certificate from the Medical Officer of a Government Hospital, as per the prescribed proforma. (placed at annexure-II – download pdf).
    • A certificate from the manufacturer of a passenger car to the effect that a booking has been made with them and that the passenger car to be delivered to the handicapped person has specifically been designed or fitted with special control devices or gadgets, depending upon the type of disability of the person, such as auto transmission, grip assembly, accelerator pedals, hand control, etc. fitted in the depending upon whether the disability is in right/left arm or in both legs or in combination.     • An affidavit by the applicant, that he had not availed of this concession in the last 5 years and that he will not dispose of the cars with excise duty concession after purchase for a period of 5 years.
  4. The application from the physically handicapped persons, duly meeting the above requirements may be sent to the following:-

  1. I want a GST& Excise duty concession certificate for handicapped person from the Govt.of India (Ministry of Heavy Industries). But how to apply for it ? Please help me. Is it possible online ? or offline. I am from Assam, Karbi Anglong District.

    Respected Madam/ Sir,
    Sub: Disabled Person –Need your help to get road tax exemptions for car
    I am 45 years old left leg disabled person with 50 % disability, I am facing lots of difficulties while mobilisation & routine work, because of that my family is also struggling a lot with me.
    Almost 2 years back I come to know that there is guideline to get excise (now GST) and road tax exemption for disabled person & left leg disabled person can buy automatic car.
    After 2 years of continuous efforts, I am able to complete all formalities & able to get Medical certificate, Manufacturer certificate & GST exemption certificate from Ministry of Heavy Industry & Public Enterprises.
    I also got the Permanent Driving Fitness Certificate from Ministry of Health & Family Welfare (Rehabilitation Centre) & got the new automatic car from Maruti last week.
    When I have submitted all documents to RTO for road tax exemption, they are saying that they cannot give me road tax exemption for automatic car.
    I have explained him that in the Permanent driving fitness certificate, Rehabilitation Centre Director has clearly mention that automatic or auto transmission vehicle is completely suitable & fit for me.
    I have also explained that now term invalid carriage has changed to adapted vehicle in amended MVA ACT in 2017. I have explained that adapted vehicle means the vehicle suitable for disabled person to drive & as recommended by Director of Rehabilitation centre. So as per them I am able to drive the automatic car that means without clutch car. Hence road tax exemption is applicable for me also.
    I have also explained him that earlier there was no option of automatic car, hence Disabled person can use only modified vehicle but now automatic car option is available in the so he/ she can get road tax exemption on this car.
    I have requested him that AEI & Rehabilitation given their certificate to support this, so please consider my request.
    I have submitted all my health check-up reports, eye sight , hearing test , mental health & Orthopaedic Doctor certificate saying I am fit for driving automatic vehicle , So please consider my request & give road tax exemption for automatic vehicle purchased by me .
    I have also explained that court have given order to give exemption for automatic vehicle by disabled person and also some other states given automatic vehicle to disabled person & also given road tax exemption to him.
    But no one listening my request to give road tax exemption for automatic vehicle purchased by left leg disabled person (me), so please understand & help.
    My earing is very less & I have seven membered family—my old father (Aged -80+) & my two small kids, 2 unmarried sisters & my wife, all are dependent on me, so please understand & help.
    My area code for vehicle registrations is MH46 & RTO centre is in Kalamboli (New Mumbai) , So please help.

    Please ask them to give applicable road tax exemption to me & process my applications ASAP. I will be highly obliged.

      You can purchase a vehicle with Automatic transmission ( without gear) and can easily drive the veicle.

    1. automateindia.in specialised in manufacturing Auto Clutch for Cars which I am using, my right leg was amputated for the past 10 years I am using their equipement fixed with my car ( Earlier Fiat OPalio, Ford and now Tata Manza nice system just cost around 25 to 30k

Myself Satish Kulkarni from Mumbai have obtained medical certificate and completed ANNEXURE-1 certified by All India Institute of Physical medicine and rehabilitation, Hajiali, Mumbai-34 a followed by affidavit notarised for not taken excise concession and not dspising of car before 5 years further approached Martin Suzuki for manufacturers cert for buying Swift Dzire AT,but the company asked for forms to be submitted for Customer with Physical Disability (with left leg disability) I have a disability of 50% for both legs.I was surprised as to how a company can decide a particular disability when Govt has issued guidelines for giving concession ,This is sheer discrimination and humiliation for the handicap persons and every time some how beg and ask for the rights.

  11. I have brought the car(Celerio AMT) and registered it as INVALID CARRIAGE. but at the time of purchase I did not applied for any excise duty excemption..can I apply for excise duty exception for my car now.

      I purchased Celerio AMT can i register as Invalid carriage. I can drive my without any modification since my left leg is affected by Polio. Please share your experience to register my car into Invalid carriage

    I am planning to purchase a car( auto gear) with modification suitable for lift leg disabled woman. i wants modification a car as like Active Honda.. Can you please specify which car manufacture do these types of modifications.

    1. You please consult nearest RTO Office. They will suggest the Car garage or any workshop which is authorized by your State Government for alteration of Car for disabled persons. You purchase a car and before Registration get it modified according to your convenience and issue a certificate. Take that certificate alongwith disabled certificate go to RTO office and get the Registration. Road Tax will be exempted. You have to a small amount of Road Tax.

  13. What is the exciser duty on an imported car. The reason is that many times an imported car suits the driver with a disability especially of the right arm as the indicator switch is on the left and auto transmission makes life much easier. I am unable to find the rebate offered in such cases.

  14. Is the concession available for cars modified for disabled passengers as suggested by the 1st point “on cars meant for physically handicapped”? Can anyone clarify about the same? Also is it available on cars such as Tata Winger?

    I am planning to purchase a car with modification suitable for lower limb disabled (both lower limbs) people. Can you please specify which car manufacture do these types of modifications for their cars models (Maruti Ltd, Hyundai Motors Ltd and ect..)

    1. I think, you should buy a old modal Maruti 800 and modified it by a person who installs a system is your car for clutch, brake and accelerator. I have done this and driving a car in just cost of Rs. 57000/- (Car cost is 50000 and modification cost is Rs. 7000/-). For any query and help please call me 9414493401..

  16. Is this applicable for maruti eeco for a disabled passenger. I am 16 and me and dad are planning to buy eeco and modify it to be wheelchair accessible in the back side. Is the concession applicable for this.
