Register a Complaint ( Persons with disabilities )

Guidelines for providing certain facilities in respect of persons with disabilities who are already employed in Government for efficient performance of their duties

Please file your complaint along with disability certificate and supporting documents as mentioned in Rule 42 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Rules, 1996 (PwD Rules) by post or by hand.
Rule 42 – Procedure to be followed by Chief Commissioner –

  1. A complaint containing the following particulars shall be presented by the complainant in person or by his agent to the Chief Commissioner for Persons with Disabilities or be sent by registered post addressed to the Chief Commissioner –
  2. The name, description and the address of the complainant;
  3. The name, description and the address of the opposite party or parties, as the case may be, so far as they can be ascertained;
  4. The facts relating to complaint and when and where it arose;
  5. Documents in support of the allegations contained in the complaint;
  6. The relief that the complainant claims.
  7. The Chief Commissioner on receipt of a complaint shall refer a copy of the complaint to the opposite party/parties mentioned in the complaint directing him to give his version of the case within a period of thirty days or such extended period not exceeding fifteen days as may be granted by the Chief Commissioner.
  8. On the date of hearing or any other date to which hearing could be adjourned, it shall be obligatory on the parties or their agents to appear before the Chief Commissioner.
  9. Where the complainant or his agent fails to appear before the Chief Commissioner on such days, the Chief Commissioner may in his discretion either dismiss the complaint on default or decide it on merits.
  10. Where the opposite party or his agent fails to appear on the date of hearing the Chief Commissioner may take such necessary action under section 63 of the Act as he deems fit for summoning and enforcing the attendance of the opposite party.
  11. The Chief Commissioner may dispose of the complaint ex parte, if necessary.
  12. The Chief Commissioner may on such terms as he deems fit and at any stage of the proceedings, adjourn the hearing of the complaint.
  13. The complaint shall be decided, as far as possible, within a period of three months from the date of notice received by the opposite party.

Vide Notification No. GSR.2(E) dated 30.12.2009, Ministry of Social Justice & Empowerment, Government of India have amended the provision relating to issuance of disability certificate in PwD Rules, 1996. It requires that the medical authority shall issue a disability certificate in Form II or Form III or Form IV as applicable.

Who to approach

Each State in India has its own State Commissioner for Persons with Disabilities. In most cases of discrimination in the area of disability, you should go to them first for redressal.

How to approach
You can approach to Chief Commissioner in one of the following ways:

You need to give certain details:
Your name, address & brief description of yourself and the nature of your disability
The name of the person (s) & organization(s) against whom you are making your complaint, together with their address & details, so far as they can be ascertained.

The facts relating to the complaint

  • What happened
  • When it happened
  • Where it happened
  • What sort of relief you are claiming

Documentation Required
You must be able to give Documents in support of the allegations contained in the complaint.
You must enclose a copy of your Disability Certificate from a valid authority.

What Happens Next

Once the Chief Commissioner has received your complaint, a copy of the complaint will be referred to the appropriate party mentioned in the complaint directing him to give his version of the case.

If necessary the parties may be heard in person.

If you (the complainant) or your agent fails to appear on the date, the Chief Commissioner in his discretion may dismiss the complaint or decide on merits.

Where the opposite party or his agent fails to appear on the date of hearing, the date of hearing, the Commissioner may take such necessary action under section 63 of the Act as he deems fit for summoning and enforcing the attendance of the opposite party.

  2. Respected sir My name is Aakash Shandilya. I am writing to you to bring to your attention a defamation case. I am working as a Senior Associate with a private firm. Yesterday (11-Mar-2022), I requested a connection over Linkedin (professional network site) to refer me for a relevant position (Neha Makol-Employee at Parexel International, Chandigarh, contact details: Neha.makol@parexel.com). She declined rudely by saying that I have got an attitude problem. Insulted, I requested her not to act like a stupid person (“bombaclot” was the word that I used). She published the entire conversation publicly. I have requested her over email to delete the post, but, all my efforts are in vain. Sir, I am a disabled person (85 percentage disability). This thing can have serious consequences on my career. I request you to look into the matter ASAP.

    Sub: Regarding noncompliance of reservation quota norms in Physically Handicapped Category in “69000 assistant teacher recruitment -2019 UP”
    Respected Sir,
    Basic Shiksha Parishad Uttar Pradesh have declared the result of assistant teacher against the “69000 assistant teacher recruitment 2019″ on 01 June 2020.
    Although this process have been put on stay by Hon’ble High Court Lucknow bench due to dispute on answer key on 03 June 2020.
    It has been observed from the result declared by” Basic Shiksha Parishad Uttar Pradesh” that they have violated the following Physical handicap reservation quota norms.in this recruitment process.
    1. Only 3 % reservation have been given instead of 4% to the PH (Physically Handicapped) category candidates ,where as UP govt have notified 4 %quota in said category in 2018 itself.
    2. PH candidate with high merit who are qualifying in Un reserved category have also been allotted PH category seats, this leads to effectively no reservation for PH category candidate specially in Orthopedic category (Overlapping rule have not been followed)
    3. The Govt. norms to carry forward the vacant PH quota seat in to the next recruitment if sufficient candidate were not found, have also been violated as The last recruitment of 68500 assistant teacher which was the first part of ongoing recruitment process, The PH quota seat were left unfilled need to be carry forwarded into this process, and this was not done by Parishad.
    4. Again the Govt. norms to interchange the one pH category seat into the other PH category if not filled up have also been violated.
    The above violation have brought the entire deserving PH category candidate in to the grave depression and left us unemployed.
    It is also pertinent to bring it to your kind notice that we all the concern PH category candidate have qualified the required exam as per the norms set by Govt. for this recruitment i.e. TET and ATR exam.
    As the recruitment process have been put on stay by Hon’ble High court, It is humbly requested that kindly direct the Basic Shiksha Parishad Uttar Pradesh to follow all the above mentioned Govt. Norms for the PH candidate in ongoing recruitment process once it’s get permission from Hon’ble court for start the recruitment proceedings again.
    In order to ensure the transparency we also demand to make the selected PH category candidate list public, PH sub categories wise with cut off marks.
    As being Physically challenged we have been left with no hope for the future as our rights have been denied.
    We beg you to look in to the matter and ensure justice for us as we have no place to go.
    We all will be highly obliged.

Complaint against Shri Rajesh Malaria Inspector working in Malaria Unit under The Directorate of Health Services AN Administration for his action of using a demeaning expression Handicapped in Social Media Whats App with the mala fide intention to make mockery & fun of my Physical Disability in Public
    Respected Sir

    1 Kind attention is invited on a message which was posted vide a Mobile no. 9474297272 One of the Group Admin on 13th Jan 2020 in a Whats App group having a count of more than 240 Members functioning in the name and style 231 P B M C Ward The said message contains a banned expression handicapped which has been texted by Shri Rajesh in his official capacity Malaria Inspector with the malicious intention to viral the above demeaning expression against self in Social Media and to make mockery and fun of my Physical Disability in public

    2 In this connection, it is germane to mention that above demeaning expression Handicapped has already been banned by The Chief Commissioner for Persons with Disabilities, New Delhi vide his letter no 1004 C C D 2012 dated 7th February 2012 Since the use of such demeaning expression violates and undermines the dignity of Persons with Disabilities which is so manifestly against the spirit of the provision of Article 21 of the Constitution of India THE RIGHTS OF PERSONS WITH DISABILITIES ACT 2016 and the United Nation Convention on the Right of Persons with Disabilities to which India is a State party

    3 The above errant employee of The Directorate of Health Services has misused the platform of social media Whats App to make utter mockery and fun of my physical disability in public and therefore has committed an offence under the provision of Section 66A of the Information and Technology Act

    4 The discriminatory action of the errant employee has blatantly violated the provisions contained in Section 3 and 7 of THE RIGHTS OF PERSONS WITH DISABILITIES ACT 2016 Thus warrants severe action in the matter

    5 Further the above employee of DHS has also breached the provision of C C S conduct Rules, since the said incumbent has used his official designation Malaria Inspector in social media Whats App to make mockery and fun of my physical disability.
    In view of the above fact it is therefore to request your good self to take cognizance of the above issue and take stern penal action against the above said Employee of DHS AN Administration as per the relevant provision of the Rules in force

    We say that We make the udid card .But Disability Certificate show in 45%.& But When make the Udid card Show in Handicap Disabilty Percentage 40%..

    country has not given us any voice.We wrote many letters to you but our letters do not
    reach you.I understand your goodness, but this hope and this letter is being sent to you in
    Biswas. Mother Bharati will definitely help me.Due to not depositing our fees, college
