    FAQs ADA Title II Compliance

These new rules say that all websites and mobile apps run by state and local governments in the U.S. must be accessible to people with disabilities. That includes online services like:

    • State and local governments
    • Public schools and universities
    • Government-run hospitals and health services
    • Public school portals.
    • Public Library websites.
    • Voting info pages.
    • Health department services

Even if these digital services are handled by third-party vendors, they still need to meet accessibility standards.

No, they don’t. These new rules only apply to public-facing websites and mobile apps. Internal tools used by government staff are not covered here.

However, under ADA Title I, government employers still need to make sure internal systems are accessible to employees with disabilities, if needed. For example, a visually impaired employee may need screen reader support on a government intranet.

Yes. In this context, “state” includes:

    • All 50 states
    • Washington, D.C.
    • Puerto Rico
    • Guam
    • American Samoa
    • U.S. Virgin Islands
    • Northern Mariana Islands

Yes. Larger areas have earlier deadlines:

    • April 24, 2026 – For governments serving 50,000+ people.
    • April 26, 2027 – For governments serving fewer than 50,000 people and special districts

The deadline depends on the population served, not the number of students.

    • Public schools and universities: Same population-based deadlines above
    • Private institutions: Must follow ADA Title III, which still requires digital accessibility

Follow WCAG 2.1, Levels A and AA. These are the Web Content Accessibility Guidelines recommended under Title II. Future updates may align with WCAG 2.2 or newer standards.

    It depends:

    • If the lawyer works for a state/local government – Yes
    • If the lawyer is independent and filing for a private client – No
    • If the lawyer is contracted by a state/local agency – Yes

Visual content must meet accessibility standards. That means:

    • Providing alt text
    • Ensuring video captions
    • Making social media posts accessible, unless they’re old (archived content may be exempt).

The government entity is ultimately responsible.

    • Even if a third-party builds your website or platform, you’re still on the hook for ensuring accessibility.
    • Contracts should clearly require WCAG 2.1 AA complianceand outline steps for enforcement.
